Miami Beach has an unusually large number of properties that generated income informally. The city restricts short-term rentals across much of its residential territory and enforces it seriously, and condominium associations layer their own minimum-lease requirements on top. Plenty of owners rented anyway — a few weeks in season, a booking platform, a friend's guests — and in an intact marriage that arrangement simply worked.
In a divorce it becomes complicated in two directions at once. The income earned during the marriage is a marital asset that has to be accounted for, so it cannot simply be omitted from a financial affidavit. But describing it accurately means describing a use that may not have been permitted, which nobody wants to put in a court filing. We rented our Miami Beach unit short-term. Do we have to disclose the income?
Financial disclosure is required in a Florida dissolution, and omitting income is a serious problem if it comes out later — it damages your credibility on every other issue. What happens to the furniture and future bookings?
Both are part of what has to be dealt with. Furnishings in a unit equipped for letting represent real value and should be named in the settlement, and any bookings already taken carry obligations and guest money. Buyers purchasing the unit will want to know which convey, so decide it before the contract rather than after.
